MyWay Protection Pty Ltd (MyWay) values and respects the privacy of the people we deal with. We adhere to the Privacy Act 1988 (Cth) (Privacy Act), including the Australian Privacy Principles and other applicable privacy laws and regulations.
This Privacy Policy (Policy) describes how MyWay collects, holds, uses, and discloses your personal information and how we maintain the quality and security of your personal information.
What is personal information?
“Personal information” means any information or opinion, whether true or not, and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable. In general terms, this includes information or an opinion that personally identifies you either directly (e.g., your name) or indirectly.
What personal information do we collect?
We collect personal information for the purpose of distributing insurance products on behalf of our insurance partners and for administering MyWay Protect on behalf of MyWay Mutual Holdings Limited (“MyWay Mutual”).
The personal information we collect about you may include your:
- name,
- mailing or street address;
- date of birth;
- email address;
- phone number; and
- billing information, including your billing address and credit card details;
- Driver’s licence details
- Driving record
- information obtained as part of management and processing a claim e.g., a police report or an incident report completed by a hirer or other driver.
- sensitive information, such as health information, if relevant to processing a personal injury claim, or criminal records, where relevant to claims processing
If you have purchased travel insurance, we will also collect from you the names and dates of birth of other travellers covered by your travel insurance. You must make sure that you have the other travellers’ permission to provide their personal information to us.
You do not have to provide us with your personal information. Where possible, we will give you the option to interact with us anonymously or by using a pseudonym. However, if you choose to deal with us in this way or choose not to provide us with your personal information, we will not be able to provide you with insurance products from our partners or process your MyWay Protect claim.
How do we collect your personal information?
We collect your personal information directly from you when you:
- request a quotation and/or purchase insurance via our website
- lodge a claim on MyWay Protect;
- provide us with information regarding a claim (e.g., hirer incident report);
- make a complaint;
- interact with us via email or over the phone;
- participate in surveys or questionnaires;
- subscribe to our mailing list;
We collect Information about your membership of MyWay Mutual and your protection under MyWay Protect from MyWay Mutual and Camplify Co (Australia) Pty Ltd (if you are an Australian member) or Camplify Co (NZ) Limited (if you are a New Zealand member)
When we collect personal information from you about someone else
We may seek to collect information from you about another person. For example, you may have details of a witness to an incident for which you’re making a claim. We will also request you to provide driver details where you weren’t driving your RV at the time of an incident or of the driver of any other vehicle involved in an incident with your RV.
If you provide us with information about another person, then you must:
have their consent to do so
- tell them that you are disclosing their personal information to us, and
- Refer them to this privacy policy.
How do we use your personal information?
We use personal information for many purposes in connection with our functions and activities, including the following purposes:
- to administer MyWay Protection, including claims and complaint handling;
- recovering money in respect of a claim, e.g., payment of an excess;
- provide you with information or services that you request from us;
- deliver to you a more personalised experience and service offering;
- improve the quality of the products and services we offer;
- internal administrative purposes;
- marketing and research purposes.
Disclosure of personal information to third parties
We do not and will not sell or deal in personal or customer information. We may disclose your personal information to:
- insurers who provide the insurance policies we distribute (e.g., battleface travel insurance)
- other members of the Camplify Holding Limited group of companies; and
- if you are a member of MyWay Mutual, to MyWay Mutual
- third parties that assist in claims handling, e.g., assessors, recovery agents, lawyers, and experts
- third parties who assist us in providing MyWay products and services to you (such as our payment services, insurance software, and other IT providers).
We may also disclose personal information to other external parties for the purposes of administering MyWay Protect, this includes:
- Regis Licensing Pty Ltd (AFSL No. 338156), for purposes connected with our authorisation to act under Regis’ AFSL;
- a credit provider who has an interest in your protected RV;
- to an insurer or other party involved in a claim, e.g., to recover monies on a claim you have made;
- statutory authorities or government departments – e.g., if we request a police report for your claim;
- Australian Financial Complaints Authority – if they contact Regis or us about a complaint you make with them.
Secure credit card payment
MyWay has engaged a globally accredited payment service provider (Adyen) to secure all aspects involving customer payment via credit cards.
All customer credit card information is securely submitted and processed entirely on specialised Adyen systems. MyWay staff cannot access, view, process, or store sensitive cardholder data (such as credit card numbers, PIN codes, or CCV codes). Credit card details are encrypted by the customer’s browser before they are sent to Adyen’s systems and are never exposed in clear text.
Transfer of personal information overseas
Some of the third-party service providers we disclose personal information to may be based in or have servers located outside of Australia, including in Germany, the United States, and Canada.
Where we disclose your personal information to third parties overseas, we will take reasonable steps to ensure that data security and appropriate privacy practices are maintained. We will only disclose to overseas third parties if:
- you have given us your consent to disclose personal information to that third party; or
- we reasonably believe that:
- the overseas recipient is subject to a law or binding scheme that is, overall, substantially similar to the Australian Privacy Principles; and
- the law or binding scheme can be enforced; or
- the disclosure is required or authorised by an Australian law or court/tribunal order.
How do we protect your personal information?
MyWay will take reasonable steps to ensure that the personal information that we hold about you is kept confidential and secure, including by:
- physical security of our premises and databases/records;
- taking measures to restrict access to only personnel who need that personal information to effectively provide products and services to you;
- conducting an IT security assessment of the measures used by our third-party service providers who process and store personal information on our behalf.
Cookies and Analytics
The MyWay website uses cookies. A cookie is a small file of letters and numbers that the website puts on your device if you allow it. These cookies recognise when your device has visited our website before, so we can distinguish you from other users of the website. This improves your experience and MyWay’s website.
Our website uses cookies to analyse website traffic and help us provide a better website visitor experience. In addition, cookies may be used to serve relevant ads to website visitors through third-party services such as Google Adwords. These ads may appear on this website or other websites you visit.
If you do not wish to use the cookies, you can amend the settings on your internet browser so that it will not automatically download cookies. However, if you remove or block cookies on your computer, please be aware that your browsing experience and our website’s functionality may be affected.
Our website uses Google Tag Manager to help us better understand visitor traffic so we can improve our services. Although this data is mostly anonymous, it is possible that under certain circumstances, we may connect it to you.
Marketing
We may send you direct marketing communications and information about our products and services, opportunities, or events that we consider may be of interest to you if you have requested or consented to receive such communications. These communications may be sent in various forms, including SMS and email, in accordance with applicable marketing laws, such as the Australian Spam Act 2003 (Cth). You consent to us sending you those direct marketing communications by any of those methods. If you wish to cease receiving any such information, you may let us know either by email or by unsubscribing at any time.
Retention of personal information
We will not keep your personal information for longer than we need to. In most cases, this means that we will only retain your personal information for the duration of your relationship with us unless we are required to retain your personal information to comply with applicable laws; for example, information relating to financial transactions and insurance policies is usually kept for 6 years.
How to access and correct your personal information
MyWay will endeavour to keep your personal information accurate, complete, and up to date.
You have a right under the Privacy Act 1988 (Cth) to access personal information that MyWay holds about you. We will respond to your request within 30 days. You may also ask us to correct this information if it is wrong. All requests should be sent to info@mywaymutual.com.
Aggregated and anonymised information
MyWay may use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands, and to assist it in meeting customer needs generally. In addition, we may use the information that you provide to improve our products and services.
Links to third-party sites
MyWay’s website may contain links to websites operated by third parties. If you access a third-party website through our website, personal information may be collected by that third-party website. We make no representations or warranties in relation to the privacy practices of any third-party provider or website, and we are not responsible for the privacy policies or the content of any third-party provider or website. Third-party providers/websites are responsible for informing you about their own privacy practices, and we encourage you to read their privacy policies.
Inquiries and complaints
For complaints about how MyWay handles, processes, or manages your personal information, please contact complaints@mywaymutual.com.au, We may require proof of your identity and full details of your request before we can process your complaint.
Please allow up to 30 days for MyWay to respond to your complaint. It will not always be possible to resolve a complaint to everyone’s satisfaction. If you are not satisfied with our response to a complaint, you have the right to contact the Office of the Australian Information Commissioner (at www.oaic.gov.au/) to lodge a complaint.
Change in privacy policy
As we plan to ensure our privacy policy remains current, this policy is subject to change. We may modify this policy at any time, at our sole discretion, and all modifications will be effective immediately upon our posting of the modifications on this website.
